1.1 Binding Agreement Welcome to MyKamra, an integrated digital marketplace platform operated by MyKamra, a company incorporated under the Companies Act, 2013, having its registered office at [Registered Address] ("Company", "MyKamra", "we", "us", or "our"). These Terms and Conditions ("Terms"), together with our Privacy Policy, Cookie Policy, and any other policies referenced herein, constitute a legally binding agreement between you ("User", "you", "your") and MyKamra regarding your access to and use of our website (https://www.mykamra.in), mobile application, and all related products, services, features, tools, content, and functionalities (collectively, the "Platform").
1.2 Explicit Acceptance BY ACCESSING, BROWSING, REGISTERING ON, DOWNLOADING OUR MOBILE APPLICATION, OR USING THE PLATFORM IN ANY MANNER WHATSOEVER, YOU: Acknowledge that you have read, understood, and agree to be legally bound by these Terms Confirm that you are at least 18 years of age or the age of majority in your jurisdiction, whichever is higher Represent that you have the legal capacity to enter into binding contracts Agree to comply with all applicable laws, regulations, and these Terms IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU MUST IMMEDIATELY DISCONTINUE USE OF THE PLATFORM AND DELETE YOUR ACCOUNT.
1.3 Electronic Signature Your registration, continued use of the Platform, or clicking "I Accept" constitutes your electronic signature and agreement to these Terms, which shall have the same legal effect as a handwritten signature under the Information Technology Act, 2000. "
2.1 Definitions Unless the context otherwise requires, the following terms shall have the meanings ascribed to them: "Applicable Law" means all applicable statutes, enactments, acts of legislature or parliament, laws, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives, and orders of any governmental authority, statutory authority, court, tribunal, or self-regulatory organization in India. "Content" means all text, graphics, images, music, software, audio, video, information, or other materials available on the Platform. "Force Majeure Event" means any event beyond the reasonable control of MyKamra, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, epidemics, pandemics, or shortages of transportation facilities, fuel, energy, labor, or materials. "Intellectual Property Rights" means all patents, copyrights, trademarks, service marks, trade names, designs, logos, domain names, and other intellectual property rights of any nature. "Listing" means any property, vehicle, advertisement space, service, or opportunity posted on the Platform by a Seller. "Losses" means all losses, liabilities, damages, costs, charges, penalties, fines, and expenses (including reasonable legal fees and disbursements). "Platform Fee" means the fees charged by MyKamra for use of the Platform services, as set forth in our Fee Policy. "Seller" or "Service Provider" means any individual, proprietorship, partnership, limited liability partnership, company, or other entity that lists assets, properties, vehicles, advertisement spaces, or services for rent or sale on the Platform. "Transaction" means any interaction, inquiry, booking request, rental, sale, agreement, or communication initiated between Users and/or Sellers through the Platform. "User" means any individual who browses, searches, communicates, submits booking requests, registers an account, or uses any services on the Platform, whether as a tenant, buyer, renter, or browser. "User Content" means all content, information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials uploaded, transmitted, or posted by Users on the Platform.
2.2 Interpretation Words importing the singular shall include the plural and vice versa References to "writing" include electronic communication Headings are for convenience only and shall not affect interpretation "Including" means "including without limitation
3.1 Marketplace Platform Only MYKAMRA IS SOLELY A TECHNOLOGY-ENABLED MARKETPLACE PLATFORM THAT FACILITATES DISCOVERY, COMMUNICATION, AND TRANSACTION INITIATION BETWEEN INDEPENDENT USERS AND SELLERS. MyKamra acts exclusively as an intermediary and technology service provider. We do NOT: Own, lease, sell, resell, manage, inspect, or control any listed assets, properties, vehicles, or advertisement spaces Act as a real estate broker, vehicle dealer, property manager, or advertising agency Guarantee the quality, safety, legality, or accuracy of any Listing Guarantee the truth or accuracy of User or Seller representations Act as an agent, representative, or partner of any User or Seller Provide legal, financial, insurance, or property management services
3.2 Services Provided MyKamra provides the following technology services: Property Marketplace: Facilitating discovery of residential, commercial, and shared properties for rent or sale Vehicle Marketplace: Facilitating discovery of vehicles for rent or sale Advertisement Space Marketplace: Facilitating discovery of advertisement spaces for rent or sale Roommate Discovery: Facilitating connections between individuals seeking shared accommodation Communication Tools: Enabling messaging and inquiry systems between Users and Sellers Payment Processing: Facilitating payment processing through third-party payment gateways (where applicable)
3.3 No Endorsement or Verification MYKAMRA DOES NOT ENDORSE, VERIFY, OR MAKE ANY REPRESENTATIONS REGARDING ANY USER, SELLER, LISTING, OR TRANSACTION. The appearance of any Listing on the Platform does not constitute an endorsement, recommendation, or guarantee by MyKamra.
3.4 No Fiduciary Duty Nothing in these Terms creates any fiduciary relationship, agency relationship, partnership, joint venture, employer-employee relationship, or franchise relationship between MyKamra and any User or Seller.
4.1 Eligibility Requirements To use the Platform, you must: Be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 Complete the registration process and provide accurate, current, and complete information Maintain the security of your account credentials Comply with all Applicable Laws
4.2 Account Security You are solely responsible for: Maintaining the confidentiality of your account password and login credentials All activities that occur under your account, whether authorized by you or not Immediately notifying MyKamra of any unauthorized use of your account or any other breach of security Ensuring that you exit from your account at the end of each session MYKAMRA SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO COMPLY WITH THESE SECURITY OBLIGATIONS.
4.3 Account Suspension and Termination MyKamra reserves the right, in its sole discretion, to: Refuse registration or cancel any account without prior notice Suspend or terminate access to the Platform for violation of these Terms Remove or edit any User Content Restrict, suspend, or terminate services for any reason, including but not limited to fraudulent activity, misrepresentation, or illegal conduct
4.4 Account Information Accuracy You warrant that all information provided during registration and thereafter is true, accurate, current, and complete. You agree to promptly update your account information to keep it accurate and complete. Providing false information constitutes a material breach of these Terms and may result in immediate account termination and legal action.
5.1 Scope of Property Listings Sellers may list the following types of properties on the Platform, subject to compliance with these Terms and Applicable Laws: Residential properties (apartments, houses, villas, builder floors) Commercial properties (offices, shops, showrooms, warehouses) Shared accommodations (PG accommodations, hostels, co-living spaces) Land and plots Other real estate assets as permitted by MyKamra
5.2 Seller Representations and Warranties Each Seller listing a property represents and warrants that: They are the legal owner of the property or have valid authorization from the owner to list and lease/sell the property The property is free from any encumbrances, liens, or legal disputes that would prevent its rental or sale All property details, including area, amenities, condition, pricing, and availability, are accurate and truthful The property complies with all Applicable Laws, including zoning laws, building codes, and municipal regulations They have obtained all necessary approvals, permits, and clearances for listing and transacting the property They will honor all confirmed bookings and agreements made through the Platform,
5.3 User Acknowledgments USERS EXPLICITLY ACKNOWLEDGE AND AGREE THAT: MyKamra does not verify property ownership, title, encumbrances, or legal status MyKamra does not inspect properties or verify the accuracy of property descriptions, images, or amenities MyKamra does not guarantee the availability, condition, or suitability of any property All property transactions are conducted at the User's sole risk Users are solely responsible for conducting due diligence, including physical inspection, verification of documents, and legal verification before entering into any transaction,
5.4 Prohibited Property Listings Sellers shall not list: Properties that are illegal, unauthorized, or encroached Properties involved in ongoing legal disputes or litigation Properties without clear title or proper documentation Properties for purposes prohibited by Applicable Law Misleading or fraudulent property listings
6.1 Scope of Vehicle Listings Sellers may list the following vehicles on the Platform: Two-wheelers (motorcycles, scooters) Cars and SUVs Commercial vehicles Other vehicles as permitted by MyKamra
6.2 Seller Representations and Warranties Each Seller listing a vehicle represents and warrants that: They are the legal owner of the vehicle or have valid authorization to rent or sell the vehicle The vehicle is registered, insured, and compliant with all motor vehicle laws The vehicle is roadworthy, safe, and maintained in proper working condition All vehicle details, including make, model, year, condition, mileage, and pricing, are accurate They possess all necessary documents, including registration certificate, insurance, pollution certificate, and permits The vehicle is free from any encumbrances, loans, or legal disputes
6.3 User Acknowledgments USERS EXPLICITLY ACKNOWLEDGE AND AGREE THAT: MyKamra does not inspect vehicles or verify their condition, safety, or roadworthiness MyKamra does not verify vehicle documentation, insurance, or legal compliance MyKamra does not guarantee the quality, safety, or legality of any vehicle Users are solely responsible for inspecting vehicles, verifying documentation, and ensuring legal compliance before any transaction
6.4 Vehicle Safety and Compliance Sellers are solely responsible for ensuring that all vehicles comply with: The Motor Vehicles Act, 1988 and rules made thereunder Insurance requirements under applicable laws Pollution control norms Safety standards and regular maintenance
7.1 Scope of Advertisement Listings MyKamra provides a marketplace for listing advertisement spaces, including: Outdoor hoardings and billboards Wall spaces for painting/advertisement Digital display spaces Transit advertising spaces Other physical promotional areas
7.2 Seller Representations and Warranties Each Seller listing advertisement space represents and warrants that: They own the advertisement space or have valid authorization to lease or sell it They have obtained all necessary regulatory approvals, permits, and clearances from municipal authorities, advertising standards councils, and other relevant bodies The advertisement space complies with all Applicable Laws, including advertising standards, content regulations, and municipal bylaws They will ensure compliance with content guidelines and will not display illegal, offensive, or prohibited content
7.3 Disclaimer of Advertising Results MYKAMRA MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING: The visibility, reach, or effectiveness of any advertisement space The number of impressions, leads, or conversions generated The demographic profile of viewers or audience engagement The return on investment or campaign success
7.4 Content Compliance Sellers and advertisers are solely responsible for ensuring that all advertisement content complies with: The Advertising Standards Council of India (ASCI) guidelines Applicable laws regarding advertising content, including those relating to obscenity, defamation, intellectual property, and consumer protection Municipal and local regulations regarding outdoor advertising
8.1 Nature of Service The Platform provides a roommate discovery feature that facilitates connections between individuals seeking shared accommodation. THIS SERVICE IS STRICTLY FOR DISCOVERY AND INITIAL COMMUNICATION PURPOSES ONLY.
8.2 Explicit Disclaimers MYKAMRA EXPLICITLY DISCLAIMS AND USERS ACKNOWLEDGE THAT MYKAMRA: Does not conduct background checks, criminal record checks, or verification of any kind on individuals using the roommate discovery service Does not verify the identity, character, financial stability, or suitability of potential roommates Does not guarantee compatibility, safety, or suitability of any roommate match Is not responsible for the conduct, behavior, or actions of any individual met through the Platform Does not participate in, facilitate, or enforce any financial, legal, or personal agreements between roommates
8.3 User Assumption of Risk USERS ENGAGE WITH ROOMMATE DISCOVERY SERVICES ENTIRELY AT THEIR OWN RISK. Users are solely responsible for: Conducting their own due diligence, background checks, and verification Meeting potential roommates in safe, public locations Assessing compatibility and suitability before entering into any living arrangement Negotiating and documenting all terms of shared living arrangements Resolving any disputes that may arise between roommates
8.4 Safety Recommendations While not obligated to do so, MyKamra recommends that Users: Verify the identity of potential roommates through government-issued ID Conduct reference checks and background verification Meet in public places before visiting private residences Inform friends or family about meetings with strangers Trust their instincts and exercise caution
9.1 Fee Structure MyKamra may charge Platform Fees for various services, including but not limited to: Listing fees for Sellers Subscription fees for premium features Transaction fees for bookings facilitated through the Platform Commission on successful transactions (where applicable) All fees are exclusive of applicable taxes (GST, etc.) unless otherwise stated.
9.2 Payment Processing MyKamra uses third-party payment gateways to process payments. By using these services, you agree to: The terms and conditions of the respective payment gateway providers Provide accurate payment information Authorize MyKamra and its payment partners to charge the applicable fees
9.3 Payment Disclaimers MYKAMRA EXPRESSLY DISCLAIMS LIABILITY FOR: Payment failures, errors, or delays caused by third-party payment processors Unauthorized transactions resulting from User's failure to secure their payment information Refund disputes between Users and Sellers for transactions conducted outside the Platform Cash transactions, offline payments, or any arrangements made outside the Platform's payment system
9.4 No Escrow Services Unless explicitly stated otherwise, MyKamra does not provide escrow services. All payments made through the Platform are processed directly and are not held in escrow by MyKamra.
9.5 Refund Policy Refund requests shall be governed by MyKamra's Refund Policy, which may be updated from time to time. MyKamra reserves the right to refuse refunds at its sole discretion, except where required by Applicable Law.
10.1 General Conduct All Users and Sellers must: Use the Platform only for lawful purposes Treat other Users, Sellers, and MyKamra representatives with respect and professionalism Honor all commitments, bookings, and agreements made through the Platform Comply with all Applicable Laws and these Terms
10.2 Strictly Prohibited Activities USERS AND SELLERS ARE STRICTLY PROHIBITED FROM: Fraudulent and Misleading Conduct Posting false, misleading, deceptive, or fraudulent Listings or information Misrepresenting identity, ownership, authority, or qualifications Engaging in bait-and-switch tactics or false advertising Creating fake accounts or impersonating others Circumvention of Platform Soliciting or accepting payments outside the Platform to avoid fees Sharing contact information with the intent to transact outside the Platform Using information obtained from the Platform to contact Users or Sellers for purposes unrelated to the Platform Illegal Activities Using the Platform for any illegal purpose or to facilitate illegal transactions Listing stolen property, counterfeit goods, or illegal services Engaging in money laundering, terrorist financing, or other financial crimes Violating any Applicable Laws Harmful Conduct Harassing, threatening, abusing, or discriminating against other Users or Sellers Posting defamatory, obscene, offensive, or harmful Content Distributing malware, viruses, or other harmful code Attempting to hack, disrupt, or interfere with the Platform's security or functionality Intellectual Property Violations Infringing on any Intellectual Property Rights of MyKamra or third parties Using MyKamra's trademarks, logos, or brand elements without authorization Copying, scraping, or data mining the Platform without permission Manipulation and Abuse Manipulating search results, ratings, or reviews Posting fake reviews or testimonials Using bots, automated systems, or scripts to access the Platform Overloading or attempting to crash the Platform infrastructure
10.3 Consequences of Violation Violation of these prohibitions may result in: Immediate suspension or termination of account Removal of Listings or Content Forfeiture of any fees or payments Legal action for damages and injunctive relief Reporting to law enforcement authorities
11.1 User Content License By posting, uploading, or submitting any User Content to the Platform, you grant MyKamra a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to: Use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content Use your name, likeness, and any other personal information in connection with such User Content Use User Content for Platform operations, marketing, promotional activities, and improving services
11.2 Content Representations You represent and warrant that: You own or have the necessary rights to all User Content you post User Content does not infringe on any third-party rights, including Intellectual Property Rights and privacy rights User Content complies with these Terms and Applicable Laws User Content is accurate and not misleading
11.3 Content Monitoring and Removal MyKamra reserves the right, but not the obligation, to: Monitor, review, or edit User Content Remove any User Content that violates these Terms or is otherwise objectionable Disclose User Content to comply with legal obligations or protect rights and safety
11.4 MyKamra Intellectual Property All Platform Content, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof, is the exclusive property of MyKamra or its licensors and is protected by Indian and international copyright, trademark, and other Intellectual Property Laws. Unauthorized use of any MyKamra Intellectual Property is strictly prohibited and may result in civil and criminal penalties.
12.1 Data Collection To improve user experience, platform performance, security, and service quality, MyKamra collects and analyzes user behavior data, including but not limited to: Search queries, filters, and preferences Click patterns, page views, and navigation paths Listing views, saves, and interactions Device information, IP addresses, browser type, and operating system Geographic location data (with consent where required) Communication patterns and response times
12.2 Purpose of Data Usage This data is used for: Personalizing search results and recommendations Improving search algorithms and platform functionality Enhancing user experience and interface design Detecting and preventing fraud, abuse, and security threats Conducting research and analytics for service improvement Targeted marketing and promotional communications (subject to user preferences)
12.3 Data Protection All data processing is conducted in accordance with our Privacy Policy and Applicable Laws, including the Information Technology Act, 2000 and rules made thereunder. We implement reasonable security measures to protect user data.
13.1 Platform Provided "As Is" THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
13.2 Comprehensive Disclaimers TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYKAMRA EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO: Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement Warranties that the Platform will be uninterrupted, timely, secure, or error-free Warranties regarding the accuracy, reliability, or completeness of any information on the Platform Warranties regarding the quality, safety, legality, or suitability of any Listing or Transaction Warranties regarding the conduct, character, or qualifications of any User or Seller
13.3 No Liability for Third-Party Actions MYKAMRA SHALL NOT BE LIABLE FOR: Any acts, omissions, or conduct of any User, Seller, or third party Any disputes, claims, or damages arising from interactions between Users and Sellers Any loss, damage, or injury resulting from use of any property, vehicle, or service listed on the Platform Any unauthorized access to or alteration of your transmissions or data Any statements or conduct of any third party on the Platform
13.4 Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: IN NO EVENT SHALL MYKAMRA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES MYKAMRA'S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO MYKAMRA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR INR 1,000 (ONE THOUSAND INDIAN RUPEES), WHICHEVER IS GREATER THESE LIMITATIONS APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF MYKAMRA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE
13.5 Exclusions Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.
14.1 Indemnity Obligation YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS MYKAMRA, ITS AFFILIATES, SUBSIDIARIES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, JUDGMENTS, AWARDS, LOSSES, COSTS, EXPENSES, OR FEES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR RELATING TO: Your use of or access to the Platform Your violation of these Terms or any Applicable Law Your violation of any third-party right, including Intellectual Property Rights or privacy rights Any User Content you post or transmit on the Platform Any Transaction or interaction between you and any other User or Seller Any damage caused to any property, vehicle, or individual arising from your use of the Platform Your negligent or willful misconduct
14.2 Cooperation You agree to cooperate fully with MyKamra in the defense of any claim. MyKamra reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you.
15.1 Termination by User You may terminate your account at any time by following the account deletion process on the Platform or contacting customer support. Upon termination: Your right to use the Platform immediately ceases All licenses granted to you terminate immediately Any pending Transactions may be cancelled Provisions that by their nature should survive termination shall survive
15.2 Termination by MyKamra MyKamra may suspend or terminate your access to the Platform, in whole or in part, at any time, with or without notice, for any reason or no reason, including but not limited to: Violation of these Terms or any Applicable Law Fraudulent, deceptive, or illegal activity Non-payment of fees or breach of financial obligations Conduct that MyKamra determines to be harmful to other Users, Sellers, or the Platform Extended periods of inactivity
15.3 Effect of Termination Upon termination: All rights and licenses granted to you immediately terminate You must cease all use of the Platform MyKamra may delete your account data and User Content (subject to legal retention requirements) MyKamra shall not be liable to you or any third party for termination of access Any outstanding obligations, including payment obligations and indemnification, shall survive termination
15.4 Platform Discontinuation MyKamra reserves the right to modify, suspend, or discontinue the Platform (or any part thereof) at any time, with or without notice, and shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
16.1 Governing Law These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.
16.2 Jurisdiction Subject to the arbitration provisions below, any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of Bangalore, Karnataka, India. You hereby submit to the exclusive jurisdiction of such courts.
16.3 Arbitration Any dispute, controversy, or claim arising out of or relating to these Terms, including their formation, interpretation, breach, termination, or validity, shall be finally resolved by binding arbitration administered by the Arbitration and Conciliation Act, 1996: Arbitrator: A sole arbitrator appointed by mutual agreement, or failing such agreement, by the Bangalore International Arbitration Centre (BIAC) Seat: Bangalore, Karnataka, India Language: English Rules: Arbitration and Conciliation Act, 1996 and BIAC Rules Costs: Each party shall bear its own costs, and the arbitrator's fees shall be borne equally
16.4 Injunctive Relief Notwithstanding the arbitration provision, MyKamra may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending the completion of arbitration.
16.5 Class Action Waiver YOU AGREE THAT ANY PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION AGAINST MYKAMRA.
MyKamra shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond MyKamra's reasonable control, including Force Majeure Events. In such circumstances, MyKamra shall be entitled to a reasonable extension of time for performing such obligations.
18.1 Right to Modify MyKamra reserves the right, in its sole discretion, to modify, amend, or replace these Terms at any time. The most current version will be posted on the Platform with the "Last Updated" date.
18.2 Notice of Changes Material changes will be notified to Users through: Email to the registered email address Notice on the Platform Push notifications (if enabled)
18.3 Acceptance of Changes Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform and terminate your account.
19.1 Entire Agreement These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and MyKamra regarding the Platform and supersede all prior or contemporaneous agreements, understandings, and communications.
19.2 Severability If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if not possible, severed from these Terms, and the remaining provisions shall continue in full force and effect.
19.3 Waiver No waiver of any provision of these Terms shall be effective unless in writing and signed by MyKamra. No failure or delay by MyKamra in exercising any right shall operate as a waiver thereof.
19.4 Assignment You may not assign or transfer these Terms or any rights or obligations hereunder without MyKamra's prior written consent. MyKamra may assign these Terms without restriction.
19.5 Third-Party Beneficiaries These Terms do not create any third-party beneficiary rights except as expressly provided herein.
19.6 Relationship of Parties Nothing in these Terms shall be construed as creating an agency, partnership, joint venture, or employment relationship between the parties.
19.7 Headings Headings are for convenience only and shall not affect the interpretation of these Terms.
19.8 Notices All notices to MyKamra shall be sent to legal@mykamra.com. Notices to Users will be sent to the registered email address or posted on the Platform.
